Introduction
In recent months, disturbing reports have emerged regarding the treatment of transgender and nonbinary individuals in U.S. Immigration and Customs Enforcement (ICE) custody. Specifically, five detainees at the privately-run Aurora Contract Detention Facility in Colorado have come forward to share their experiences of mistreatment, discrimination, and neglect. As advocates for justice and human rights, we must shed light on their stories and demand accountability.
The Complaint
The Rocky Mountain Immigrant Advocacy Network, the National Immigration Project, and the American Immigration Council jointly filed a complaint on April 9, 2024, with the Department of Homeland Security’s Offices for Civil Rights and Civil Liberties, Immigration Detention Ombudsman, and Inspector General, as well as ICE’s Office of Professional Responsibility. This complaint represents the voices of those who continue to suffer within the detention system.
Detainee Experiences:
1. Charlotte
2. Myriah and Elsa
Myriah and Elsa allege that they do not have regular access to hormones and other related health care. For transgender individuals, access to gender-affirming care is crucial, yet these detainees face barriers.
Omar, who identifies as both trans and nonbinary, expressed a desire to start hormone replacement therapy. However, they fear being placed in solitary confinement if they pursue this treatment. The lack of nonbinary or men’s transgender housing units at the Aurora facility further complicates their situation.
4. Threats of Isolation
Other detainees have reported threats of isolation. Staff members have warned them that starting therapy would result in placement in “protective custody” (solitary confinement). This misinformation prevents individuals like Omar from accessing necessary treatment.
5. Degrading Comments and Gender-Based Mistreatment
Victoria, Charlotte, and Myriah have faced degrading comments and mistreatment due to their gender identity. One female guard assigned to the housing unit for transgender women has been particularly problematic. She confiscated personal hygiene products and replaced them with menstrual pads and tampons, despite knowing they were unnecessary.
Conclusion
As advocates, we stand in solidarity with these detainees. Their stories underscore the urgent need for reform within the immigration detention system. We call upon authorities to investigate these allegations thoroughly, ensure proper medical care, and address the discriminatory practices that persist. No one should suffer mistreatment based on their gender identity.
